The establishment of paternity through a DNA test.

In recent years, the technology for DNA testing technology has improved immensely. A simple swab from the inside of a child's cheek can be tested and compared with the cheek swab of a potential father. This can be an important factor contributing to a father's rights to spend time with his son or daughter and to be responsible for the care, support and well-being of his child.

The establishment and ordering of proper child custody and visitation agreements.

Without a paternity test, a father does not legally have the right to seek full custody or visitation. Once a paternity test comes back the father's rights can be recognized, and it is important that the mother and father both enter into custody arrangements that allow both parents access to the child and participation in the child's life.

The establishment and ordering of the correct amount of child support.

When a father can be determined, a child support order can be entered. This is important, as a child should be supported by both parents. When the proper father can be established, the correct person will be responsible for the child's support.

  • When an administrative paternity action has been brought by the state, this action often only addresses the establishment of paternity and determining child support. Creating child custody and visitation agreements is left up to the parents.

Parenting Plans

The Missouri Supreme Court has created and approved a proposed parenting plan that may be put in place by parents after paternity has been established. However, this type of parenting plan may not be right for everyone and must be carefully discussed with a lawyer in order to ensure that the parents' and children's rights are protected.
